TAYLORVILLE — Published Christian County court appearances reflect the daily 10:00 a.m. criminal call and do not necessarily account for all felony proceedings heard that day.
The following cases were heard by Judge Brad Paisley from the Fourth Judicial Circuit on December 21, January 4, January 5, and January 8:
- Kyle T. Adler, 23CF95. (Aggravated battery of a peace officer; domestic battery causing bodily harm.) There was a status hearing on a motion for furlough that which was granted by the court. The a status hearing is set for February 2, 2024.
- Ashley N. Bain, 23CF159. (Delivery of meth in an amount between fifteen to 100 grams.) The petition to detain was denied and is ordered to comply with pre-trial services. Pre-trial was continued to February 20, 2024.
- Brock A. Drockton, 14CF180. (Possession of a controlled substance)The defendant was released and ordered to comply with probation services. Pre-trial is continued to February 20, 2024.
- Jerry W. Riggs, 20CF147, 23CF21, 23CF170. (Eight counts for the delivery of five or less grams of meth with four of the counts amended or reduced. served 148 days in jail with credit for 74 served. Serving two years of probation; Domestic battery causing harm with one or more previous convictions.) The plea hearing has been set for January 19, 2024.
- Melissa J. (Garrett) Foreman, 22CF250. (Aggravated battery in a public place; battery causing bodily harm.) The defendant agreed to the plea deal. Count two is dismissed as part of the agreement. The defendant will serve one year of conditional discharge and is ordered to comply with probation services.
- Jeremy T. Stark, 22CF201. (Two counts for aggravated battery in a public place; criminal damage in an amount ranging between $10K-$100k.) There was a status on a plea deal and the defendant is ordered to comply with pre-trial services. The plea hearing will be February 2, 2024.
- Jahquel D. Pearsall, 23CF18. (Burglary/ charge amended or reduced; burglary without causing damage.) There was a status hearing on the plea deal and a possible plea hearing was set for February 2, 2024
- Robert N. Roark, 22CF231. (Burglary.) The preliminary hearing was held today finding probable cause for the charges. Pretrial is scheduled for February 8, 2024.
- Dennis E. Wilcutt, 23CF42, 23CF164. (Two counts of violating the sex offender registry.) There was a status hearing regarding pre-trial. An additional pre-trial will be on January 9, 2024.
- Vanessa A. Esparza, 23CF143 (Aggravated battery of a peace officer; driving under the influence of alcohol; unlicensed.) The defendant was given notice to appear on Jan. 18, 2023 at 10 a.m.
- Ace D. Kobe, 23CF119. (Aggravated battery of a peace officer.) There was an updated provided and a pre-trial hearing was set for February 2, 2024.
- Kayla M. Durbin, 23CF75. (Delivery of five or less grams of meth.) there was a status hearing and a plea hearing was scheduled for February 22, 2024.
- Derik W. Steck, 20CF307, 23CF179. (Two counts for the delivery of five or less grams of meth; possession of 100 to 400 grams of meth.) The defense made a motion for treatment furlough. The motion was denied and pre-trial was set for Jan. 11, 2024.
- Steven D. Leonard, 23CF47, 23CF175. (Driving under the influence of alcohol; driving with a revoked or suspended license; Unlawful restraint; domestic battery making physical contact.) A motion for furlough was heard and the motion was denied. The next hearing is set for Jan. 19 2024.
- Lacey J. Austin, 23CF9, 23CF127. (Theft of display merchandise in an amount less than $300; residential burglary.) Pre-trial was continued to February 20, 2024.
- Cole A. Montgomery, 22CF138, 23CF14, 23CF169. (Two counts of aggravated fleeing from the police while going twenty-one miles over the speed limit/ served 104 days in jail with credit for 57, serving 24 months of probation; domestic battery making contact with one or more previous convictions.) There was a status hearing regarding fitness and an addition fitness hearing was set for February 6, 2024.
- Tyrone A. Powyszynski 22Cf129, (Burglary) The defense provided an update on treatment and pre-trial was scheduled for February 20, 2024.
- Roy J. Bates (Murder with intent to kill or injure; attempt to disarm a peace officer or corrections employee; category two armed violence; two counts of aggravated battery causing great bodily harm to a peace officer; five counts of aggravated battery to a peace officer.) The first appearance was held and probable cause was found for the charges. The public defender was appointed. The first appearance with the public defender will be Jan. 8, 2024.
- Robin R. Jones, 20CF149. (Delivery of less than five grams of meth/ dismissed by motion of the state; possession of meth in an amount under five grams/ served two days in jail with credit for one. Serving two years of probation with thirty hours of community service.) An update to treatment was provided and pre-trial was continued to February 9, 2024.
- Charles R. Warren, 19CF296, 21CF117, 19CF234, 22CF159. (Four counts possession of five or fewer grams of meth.) There was a status update regarding the case and if the defendant will be able to represent himself during trail. The motion for the defendant to represent himself was denied. The final pre-trial is set for March 19, 2024 and the jury trial is scheduled for April 1, 2024 at 8:30 am.
- George T. Bailey, 19CF114, 20CF260, 22CF89, 22CF91. (Aggravated domestic battery involving a strangle/ dismissed by motion of the state; domestic battery causing harm with two or more previous convictions/ 182 days in jail with credit for 182 served, one year in the department of corrections and two years of probation; aggravated assault of a peace officer, firefighter, or emergency worker/ one year in the department of corrections and 182 days of credit for time served; three counts of possession of five or fewer grams of meth;) The defendant was given notice to appear January 23, 2024 at 10 am.
- Brian M. Dailey, 21CF251, 23CF150. (Delivering between five to fifteen grams of meth; possession of five to fifteen grams of meth; possession of five or less grams of meth/ sixteen days in jail with credit for eight, thirty hours of public service, twenty-four months of probation. ) There was a update on discovery of evidence for the defense and a possible plea agreement will be heard on February 27, 2024.
- Roy J. Bates, 24CF6. (Murder with intent to kill or injure; attempt to disarm a peace officer or corrections employee; category two armed violence; two counts of aggravated battery causing great bodily harm to a peace officer; five counts of aggravated battery to a peace officer.) The preliminary hearing was held during the first appearance with council. The state motioned to deny pre-trial release. Pre-trial release was denied and the defense plead not guilty. The next hearing will be on Jan 12, 2024.
The following cases were heard before Judge Douglas Jarman on December 29:
- Seymone A. Pelichoff, 23CF197.(Aggravated battery in a public place; domestic battery making physical contact.) The first appearance was held today finding probable cause for the charges. The defendant was released with conditions and ordered to comply with pre-trial services. Pre-trial is set for February 1, 2024.
- Jacob A. Bright, 22CF245. (Aggravated battery in a public place.) A status update was provided regarding discovery. An additional pre-trial was set for February 16, 2024.
- Landon S. Moore, 23CF13. (Possession of five or less grams of meth.) Pre-trial was continued to January 29, 2024.
